LEGAL NOTICE OF

PUBLIC HEARING

PLEASE TAKE NOTICE that the Board of Trustees of the Village of Roslyn Estates will hold a public hearing at 7:30 PM on Monday, July 15, 2019, at the Village Hall, 25 The Tulips, Roslyn, New York 11576, with respect to:

Bill 3 of 2019, a local law amending Chapter 200, ‘Zoning,’ of the Code of the Village of Roslyn Estates, with respect to Fencing.

Section 1. Legislative Intent. The Board of Trustees of the Village of Roslyn Estates has determined that the health, safety and welfare of the Village and its residents is served by restricting the materials that may be used in fencing permitted to be erected and maintained in the Village. The Board finds that chain link and wire mesh materials in fencing detracts from the aesthetics of the Village, adversely impacting properties in the Village, and should therefore be restricted, except in the context of certain fencing required for sports courts.

Section 2. Clause ‘I’, ‘Fences and Walls,’ of § 200-21, ‘Permitted Uses,’ of said Chapter 200, is hereby amended by adding a new sub-clause ‘8.’ thereto, to read in its entirety as follows:

‘(8). Except with respect to fencing that encloses a game court as permitted pursuant to Village Code Section 200-11.1(H), no chain link or wire mesh fence is permitted on any premises located within the Village. Any chain link or wire mesh fencing installed on any building lot prior to the effective date of this provision may be maintained; provided, however, that any such existing chain link or wire mesh fencing shall be removed at such time as any portion of such existing chain link or wire mesh fence is replaced, or at such time as more than 50% of any such existing chain link or wire mesh fence is repaired, and, upon the removal thereof, all fencing installed to replace same shall satisfy the requirements of this sub-clause.’

Section 3. Effective date. This local law shall take effect immediately.

Persons who may suffer from a disability which would prevent them from participating in said hearing should notify Michael Tomicich, Village Clerk, at (516) 621-3541 in sufficient time to permit such arrangements to be made to enable such persons to participate in said hearing.
