NOTICE IS HEREBY GIVEN that the BOARD OF ZONING APPEALS of the INCORPORATED VILLAGE OF EAST HILLS has scheduled a meeting and public hearings via videoconference pursuant to Governor’s Executive Order 202.49 for July 28, 2020 at 4:00 PM to consider the following:

CONTINUED FROM JUNE 16, 2020 MEETING: JOSHUA STEIN requests ONE VARIANCE for the property known as 125 CRESCENT LANE designated as Section 7 Block 133 Lot 7 on the Nassau County Land and Tax map and within the R2 District of the Village. Pursuant to East Hills Code §271-47(b), Accessory buildings and uses, accessory structures must be located at least five feet from the rear lot line and ten feet from the side lot line. The rear yard patio is located on the side yard property line. Therefore a variance is requested for ten feet of side yard setback.

CONTINUED FROM JUNE 23, 2020 MEETING: JESSICA GUETA requests a SPECIAL EXCEPTION AND EIGHT VARINCES for the property known as 115 SYCAMORE DRIVE designated as Section 7 Block 249 Lot 54 on the Nassau County Land and Tax Map and within the R1 District of the Village. Pursuant to East Hills Code §271-139(A), swimming pools require a special exception from the Zoning Board of Appeals. Pursuant to East Hills Code §271-143(A)(6), a pool drywell is to be separate, not interconnected to yard drains and a variance is requested. Pursuant to East Hills Code §271-142(B), a pool drywell must be located at least 20 feet from the proposed swimming pool. The proposed drywell is located 10 feet from the pool and a variance is requested. Pursuant to East Hills Code §271-23(A), accessory buildings and uses, accessory buildings or structures shall not occupy more than 20 percent of the rear yard. The proposed rear yard lot coverage is 35 percent. Therefore, a variance is requested. Pursuant to East Hills Code §271-261(A), retaining walls, a new retaining wall or single tier of a multi-tiered wall shall not exceed four feet in height. The proposed retaining wall is 6 feet in height and a variance is requested. Pursuant to East Hills Code §271-14 (A), the maximum allowable fence height is 4 feet. Pursuant to East Hills Code §271-143(A)(1) and (3), pool enclosure fences must of the chain link type, and be erected completely enclosing the pool at least five feet from the edge of the pool and at least 15 feet from any property line. Therefore, variances are requested for the proposed 5 foot fence, partially of the estate type, located along the property line and not completely enclosing the pool.

CONTINUED FROM JUNE 23, 2020 MEETING: WILLIAM SHTAINER requests a SPECIAL EXCEPTION AND FOUR VARIANCES for the property known as 135 REDWOOD DRIVE designated as Section 7 Block 291 Lot 1 on the Nassau County Land and Tax Map and within the R1 District of the Village. Pursuant to East Hills Code §271-139(A), swimming pools require a special exception from the Zoning Board of Appeals. Pursuant to East Hills Code §271-14 (A), the maximum allowable fence height is 4 feet. Pursuant to East Hills Code §271-143(A)(1) and (3), pool enclosure fences must be of the chain link type, be erected completely enclosing the pool at least five feet from the edge of the pool, and at least 15 feet from any property line. Therefore, variances are requested for the proposed 5 foot fence, partially of the estate type, located along the property line. Pursuant to East Hills Code §271-23(A), accessory buildings and uses, accessory buildings or structures shall not occupy more than 20% of the rear yard and the yard area occupied by the accessory buildings or structures shall be included in computing the maximum percentage of the lot area which may be utilized for buildings. The proposed rear yard lot coverage is 5,166 sf exceeding the 3,352 sf permitted and a 1,814 sf rear yard lot coverage variance is requested.

BRADLEY MARKS requests a SPECIAL EXCEPTION for the property known as 90 FIR DRIVE Section 7 Block 274 Lot 2 on the Nassau County Land and Tax Map and within the R1 District of the Village. Pursuant to Village of East Hills Code §271-162, where permitted, Athletic Courts require a special exception from the Zoning Board of Appeals. Therefore, consideration is requested.

HARRIS AND MELODY CLARK request modification of the swimming pool that is the subject of the July 19, 2018 decision of the Zoning Board of Appeals for the property known as 18 LAWN DRIVE, designated as Section 7 Block 273 Lot 33 & 36 on the Nassau County Land and Tax map and within the R1 District of the Village. All changes to an existing Special Exception must be presented to the Zoning Board of Appeals for approval. Therefore, consideration is requested.
