NOTICE OF PUBLIC

HEARING

733 MIDDLE NECK ROAD (Section 1/Block 1/Lot 5)

PLEASE TAKE NOTICE, that the Zoning Board of Appeals of the Village of Great Neck shall hold a public hearing on Thursday, April 4, 2019 at 7:30PM at Village Hall, 61 Baker Hill Road, Great Neck, NY 11023, to hear the application of Yosef Shemtov, applicant, represented by, architect, for the premises at 733 Middle Neck Road in Great Neck. The applicants are seeking the following variance(s) from the Village Zoning Codes:

1. Section § 575-129A Use

Your building permit application to maintain (2) non-conforming 2 story residential cottages, one cottage on the right at 768 square feet, and one cottage on the left at 1050 square feet, at the rear of an existing 2 family dwelling​/​commercial parcel, in the Business A Zone, is a not permitted use in the district.

2. Section § 575-134 Minimum Side Yards

No side yard shall be required; but, if any is provided, then its least dimension shall be not less than four feet.

The minimum required side yard is 4 feet, the actual is 1 foot and 2 feet.

3. Section § 575-135 Minimum Rear Yards

There shall be a rear yard, the depth of which shall not be less than 10 feet.

The minimum required rear yard shall be 10 feet, the actual is 6 feet.

4. Section § 575-156 Parking and Storage in Business A Districts.

A.Parking. On each lot or premises on which an authorized use is instituted or maintained, there shall be provided an accessory parking facility meeting the minimum standards hereinafter set forth

(4) All other uses: For each 250 square feet of gross floor area in excess of an area equal to 70% of the lot area there shall be provided one parking space.

As per the prior application, the required parking for the parcel was fifteen spots which received a parking waiver allowing eleven spots which was reduced to five spots. The new proposal for the two cottages would require an additional four spaces.

The applicant is requesting a variance for relief of the requirement for four parking spots.

5. Section § 575-164 Placement of Dwelling

B. No building situated in back of or to the rear of a building on the same lot at the effective date of this chapter shall be altered or used for dwelling purposes.

6. Section § 575-171 Nonconforming buildings and nonconforming uses

The following provisions shall apply to all buildings and uses existing on the effective date of this chapter which do not conform to the requirements set forth in this chapter and to all buildings and uses that become nonconforming by reason of any subsequent amendment to this chapter.

A.Nonconforming buildings and nonconforming uses. Any nonconforming use of buildings or open land existing at the time of adoption of the original ordinance on December 3, 1930, may be continued indefinitely but shall not be:

(1) Enlarged, altered, extended, reconstructed or restored, except as provided in Subsection A(5), or placed on a different portion of the lot or parcel of land occupied by such use on the effective date of this chapter, nor shall any external evidence of such use be increased by any means whatsoever.

(3) Changed to another nonconforming use without approval by the Board of Appeals, and then only to a use which, in the opinion of the Board of Appeals, is of the same or of a more restricted nature.

The premises also known as Section 1, Block 128, Lots 22-24 on the Nassau County Land and Tax Map, and are located in the Business A Zoning District. A copy of the application material is available for review in the Village of Great Neck Building Department, Village Hall, during regular business hours.
