NOTICE OF PUBLIC HEARING

22 Beach Road (Section 1/Block 133​/​Lots 5,6,7,8)

PLEASE TAKE NOTICE, that the Zoning Board of Appeals of the Village of Great Neck shall hold a public hearing on Thursday, December 6, 2018 at 7:30PM at Village Hall, 61 Baker Hill Road, Great Neck, NY 11023, to hear the application of David Nahamoo and Jim Benjamin, of 22 Beach Road Development, owners, represented by Eric Palatnik, attorney, for the premises at 22 Beach Road in Great Neck. The applicants are seeking the following variance(s) from the Village Zoning Codes:

Regarding Lots 5 and 6:

1. ßSection 575-81 Minimum Lot Width on an Interior Lot:

(1) A minimum lot width of 50 feet shall be maintained from the street line for the first 100 feet of lot depth or 30 feet beyond that point of construction of the principal building that is farthest from the street line, whichever distance is greater.

The proposed lot width for the first 100 feet is 45 LF. And a lot width of 18 LF for the next 19 LF.

2. ßSection 575-84 Front Yards

All lots shall have at least one front yard. All front yards shall have a minimum depth equal to the greater of 20 feet or the average depth of the front yards of other lots which are on the same block front and within 200 feet.

The proposed front yard is 20 feet-5 inches the average setback within 200 LF is 30 LF.

 3. ßSection 575-86 Rear Yards

There shall be a rear yard, the depth of which shall be 25 feet plus the depth of the lot in excess of 100 feet.

The required rear yard is 26.7 LF and 7 feet-11 inches is provided.

4. ßSection 575-87 Permitted Encroachments

A. (3) The following encroachments into required yards are hereby permitted:

One-story open porch, having a maximum eave height of 12 feet, and a terrace, neither one of which may project more than 5 feet into a minimum front yard.

The proposed open terrace at 2 feet-6 inches x 25 feet-9 inches encroaches into the front yard.

The area well on the right side yard is a none listed encroachment that projects into the yard by 5 LF x 12 LF.

5. Section 575-89 Accessory Buildings​/​Structure

B. Unless otherwise provided in this article, accessory buildings or structures shall be located in the rear yard and shall not be less than 10 feet distance from the main building and not less than three feet distant from the rear and side lot lines.

The proposed retaining wall as an accessory structure is two feet from the rear of the house and two feet from the side yard.

Regarding Lots 7 and 8:

1. ßSection 575-81 Minimum Lot Width on an Interior Lot:

(1) A minimum lot width of 50 feet shall be maintained from the street line for the first 100 feet of lot depth or 30 feet beyond that point of construction of the principal building that is farthest from the street line, whichever distance is greater.

The proposed lot width for the first 100 feet is 44LF. And a lot width of 39 feet-9 inches LF for the next 9 LF.

2. ßSection 575-84 Front Yards

All lots shall have at least one front yard. All front yards shall have a minimum depth equal to the greater of 20 feet or the average depth of the front yards of other lots which are on the same block front and within 200 feet.

The proposed front yard is 21 feet-0.3/4 inches the average setback within 200 LF is 30 LF.

3. ßSection 575-87 Permitted Encroachments

A. (3) The following encroachments into required yards are hereby permitted:

One-story open porch, having a maximum eave height of 12 feet, and a terrace, neither one of which may project more than 5 feet into a minimum front yard.

The proposed open terrace at 2 feet 6 inches x 25 feet 3 inches encroaches into the front yard.

The area well on the right side yard is a none listed encroachment that projects into the yard by 5 LF x 12 LF.

4. Section 575-89 Accessory Buildings​/​Structure

B. Unless otherwise provided in this article, accessory buildings or structures shall be located in the rear yard and shall not be less than 10 feet distance from the main building and not less than three feet distant from the rear and side lot lines.

The proposed retaining wall as an accessory structure is nine feet from the rear of the house and two feet from the side yard.

The premises also known as Section 1, Block 133, Lots 5,6,7,8 on the Nassau County Land and Tax Map, and are located in the Residence C Zoning District. A copy of the application material is available for review in the Village of Great Neck Building Department, Village Hall, during regular business hours.

If anyone needs special accommodations for a disability, such person should contact the Village Clerk at least 5 days prior to the hearing. At said hearing, all parties and interests will be given an opportunity to be heard.
