INCORPORATED VILLAGE OF GREAT NECK ZONING BOARD OF APPEALS NOTICE OF PUBLIC HEARING 134 MAPLE STREET (Section 1/Block 60/ Lot 67) PLEASE TAKE NOTICE, that the Zoning Board of Appeals of the Village of Great Neck shall hold a virtual public hearing via Zoom on Thursday, March 3, 2022 at 7:30PM https://us02web.zoom.us/j/88356725404 or by calling 1 929 436 2866, Meeting ID 883 5672 5404.  The Zoning Board of Appeals of the Village of Great Neck shall hear the application of Daniel Khodadian, owner, represented by Paul Bloom, attorney, for the premises at 134 Maple Street in Great Neck. The†applicants are seeking the following variance(s) from the Village Zoning Codes in connection with their application for the construction of a new single-family dwelling:1.§Section 575-9 Building Area and Floor Area A. For single-family dwelling use, the building area shall not exceed 20% of the lot area and, subject to any modifications required by ߆575-167 of this chapter, the floor area ratio shall not exceed the limits hereinafter set forth: (1) On interior lots: 0.33 of the first 10,500 square feet of lot area; 0.20 of the lot area in excess of the first 10,500 square feet which is less than 150 feet from the street on which the lot abuts; and 0.10 of the lot area in excess of the first 10,500 feet which is further than the 150 feet from said street. The maximum allowed FAR is 4,740 square feet, the proposed is 5,760.22 square feet. A variance of 1,020.22 is required. 2.§Section 575-14 Side Yards† A. On an interior lot, a single-family dwelling shall have two side yards, where the aggregate width of the two side yards shall not be less than 30 feet, plus 2/5 of the width of the lot in excess of 70 feet. The proposed aggregate side yards are 28.583 feet at the walls and 20.583 feet at the  stairs and railing. A variance of 3.417 feet and 11.417 feet, respectively, is required. 3.§Section 575-14 Side Yards A. On an interior lot, a single-family dwelling shall have two side yards, where the aggregate width of the two side yards shall not be less than 30 feet, plus 2/5 of the width of the lot in excess of 70 feet. A minimum side yard of 12.8 feet is required. The side yard provided at the stair railing is 6.291 feet.† A variance of 6.509 feet is required. 4.§Section 575-16 Permitted EncroachmentsA. The following encroachments into required yards are hereby permitted: (6) Unenclosed and unroofed platform and steps, designed to provide safe access to grade from service entrance doors, may extend not more than three feet six inches into a minimum side yard. The maximum horizontal surface of any encroaching platform shall not exceed 14 square feet. The stairs are not a permitted encroachment because they are bigger than 14 SF  5.§Section 575-168 Facades of Single-Family Dwellings A.†No horizontal plane of a front or side facade shall extend for more than 30 feet without a change or break in said plane of at least two feet in width. The horizontal plane of a front facade shall have at least one break of at least two feet in width, regardless of the overall width of the facade. The south faÁade has a portion of 35.354 feet which is uninterrupted, which is 5.354 feet longer than allowed.  6.§Section 575-168 Facades of Single-Family Dwellings B.†No more than 75% of a two-story front or side facade shall be made in one vertical plane; the balance of said facade shall follow a vertical plane which is separated from the former plane by at least two feet. A projecting chimney shall not be considered a separation. A skirt roof does not represent 25 % of the side facades. 7.§Section 575-168 Facades of Single-Family Dwellings D. The eave of an open porch on the front of a dwelling shall not exceed 12 feet in height. The proposed eave is 20 feet, which is 8 feet more than allowed.The premises also known as Section 1, Block 60, Lot 67 on the Nassau County Land and Tax Map, and are located in the Residence AA Zoning District.
