Public Hearing: The Board of Trustees of the Village of Kings Point

Legal Notice The Board of Trustees of the Village of Kings Point will hold a public hearing at 8:15 p.m., on November 23, 2020, at the Village Hall, 32 Steppingstone Lane, Kings Point, New York 11024, with respect to Bill 14A of 2020, which reads, as follows:Bill 14A of 2020, A local law amending the Code of the Village of Kings Point with regard to the definition of mean grade and building heights.Be it enacted by the Board of Trustees of the Village of Kings Point.Section 1.       The definition of Mean Grade of a Structure in subsection A, of § 100-11, Maximum increases in elevation, of Chapter 100, Land Development, of the Code of the Village of Kings Point, is hereby amended to read as follows: “The average level of the ground at the outermost perimeter of the foundation walls of a structure with a foundation, based upon spot elevations determined by the Building Inspector, and the outermost lowest exposed bottom face of all retaining walls used to build up grades around that structure.  If the structure has no foundation, the average level of the ground at the exposed bottom face of such structure, based upon spot elevations determined by the Building Inspector, and the outermost lowest exposed bottom face of all retaining walls used to build up grades around that structure”Section 2. The definition of Height of a Building in § 161-3, Definitions, of Chapter 161, Zoning, of said Code, is hereby amended to read as follows:“For all single-family dwellings: the vertical distance between the mean final level of the ground at the outermost perimeter of the foundation walls, and the outermost lowest exposed bottom face of all retaining walls used to build up grades around a cellar, basement, or structure, and the mean level between the eaves and the highest point of a peaked roof, or the highest point of the roof if the roof is any other type.”Section 3. Subsection A, of said § 161-30.4, Height limitations, of said chapter 161, is hereby amended to read as follows:“No building with a flat roof shall exceed 25 feet in height. A building with any type of roof other than a flat roof shall not exceed 30 feet in height. With respect to a building with a peaked roof, the dimension on the roof between where the building height is measured, and the ridgeline shall not exceed an additional five feet. Flagpoles, finials, radio and television antennas (other than parabolic antennas) and chimneys, when affixed to a building, may extend not more than five feet above the roof of the building, but in no event more than 40 feet above the ground level where building height is measured. Notwithstanding the foregoing, radio or television antennas (other than parabolic antennas), when affixed to a chimney, may extend not more than three feet above the top of the chimney, but in no event more than 40 feet above the ground level where building height is measured.”Section 4. Subdivision 3, of subsection B, or said § 161-30.4 is hereby amended to read as follows:“For purposes of this section, all distances shall be measured along the shortest horizontal line between the nearest lot line and a vertical plane running through the point being measured, which plane is parallel to such lot line, and the grade shall be the mean final level of the ground level where building height is measured on that side of the dwelling which faces the lot line to which the measurement is being made.”Section 5.        Effective date.  This local law shall take effect immediately.Persons who may suffer from a disability, which would prevent them from participating in said hearing, should notify Gomie Persaud, Village Clerk-Treasurer, at (516) 504-1000 in sufficient time to permit such arrangements to be made to enable such persons to participate in said hearing.Dated:  Kings Point, New York   October 28, 2020   BY ORDER OF THE BOARD OF TRUSTEES VILLAGE OF KINGS POINT   Gomie Persaud, Village Clerk-Treasurer
