PLEASE TAKE NOTICE

The Board of Trustees of the Village of Kings Point, at a regular meeting held on Monday, October 15, 2018, duly adopted Local Law 11 of 2018, which reads as follows:

Local Law 11 of 2018, a local law amending Chapter 161, Zoning, of the Code of the Village of Kings Point, with regard to the definition of “Floor Area.”

Be it enacted by the Board of Trustees of the Village of Kings Point.

Section 1. Subdivision 2, of section A, of the definition of “FLOOR AREA” in ß 161-3, Definitions, of Chapter 161, Zoning, of the Code of the Village of Kings Point is hereby amended, to read as follows:

“(2) Floor space of each story above the basement and below the attic, irrespective of its use, and that portion of the area of any attic space, whether or not floor has been laid, with collar ties set at a height of 7 1/2 feet or more. The floor space of any area with a structural headroom of 15 feet or more shall be counted twice.”

Section 2. The definition of “STRUCTURAL HEADROOM” in said ß 161-3, is hereby amended to read as follows:

“STRUCTURAL HEADROOM​—​The clear vertical space between essential structural load-bearing members designed and constructed to function as a whole in supporting and transmitting applied structural frame loads safely to the ground. Dropped soffits, ceilings, overhangs, and beams that are independently removable from the roof, floor, and wall assemblies without altering structural load paths of the rest of the building from being transmitted safely to the ground, shall not be deemed to be essential structural load-bearing members.’

Section 3. Effective date.

This local law shall take effect immediately.
