Readers Write: Blame for requiring candidate certification with Albany

Under New York State Election Law 15-108(8)(b), “a certificate of acceptance or declination of an independent nomination for an office to be filled at the time of a general or special village election shall be filed not later than three days after the last day to file the petition which made such independent  nomination.”

Thus, people who file petitions by the Tuesday 2/13/18 deadline in a village clerk’s office to run for office are required to confirm by Friday 2/16/18 that they want to run.

Whether the filing of petitions is a sufficient indication that people are seeking office without asking them to prove they really mean it is a question for the New York State Legislature not the village clerk.
