Public Hearing: The Board of Trustees of the Village of Kings Point

PLEASE TAKE NOTICE The Board of Trustees of the Village of Kings Point will hold a public hearing at 4:00 p.m., on Thursday, March 17, 2022, with respect to Bill 1B of 2022, which read as follows:1. †Bill 1B of 2022, a local law amending the zoning provisions of the Code of the Village of Kings Point with regard to floor area, retaining walls, and driveways.Section 1. The definition of Floor Area in Subsection A, of ß 161-3, Definitions, of Chapter 161, Zoning, of the Code of the Village of Kings Point is hereby amended by adding a new subdivision 5, to read as follows:ì(5) Floor space of attics, of any height that occur at the same level of a cellar, first floor, or second floor of a building.îSection 2. †The definition of Floor Area in Subsection B, of said ß 161-3 is hereby amended by adding new subdivisions 10 and 11, to read, respectively, as follows:ì(10) Floor space of attics that are located directly above the highest story of a building with collar ties set at a height of less than 7 feet.îì(11) Notwithstanding the provisions in paragraph 5, of subsection A, of this section, floor space of unfinished attics that occurs at the same level of a cellar, first floor, or second floor of a building, which, in the opinion of the Architectural and Preliminary Site Review Board, do not add substantial bulk mass to a building, do not have the potential to be used for habitable space, and shall not be used for anything other than mechanical utility space or unfinished storage.îSection 3. †ß 161-34, Driveway curb cuts and driveway aprons, of said Code is hereby retitled and amended to read as follows:ìß 161-34. Driveways.A. No curb cut for a driveway shall exceed 20 feet.B. The driveway apron and the width of the curb cut in a public street shall be determined by the Superintendent of the Department of Public Works.C. Driveways shall extend at least 28 feet from the face of any building wall with a garage door entrance, plus provide an additional 6 feet from the driveway to the property line to provide a space sufficient for evergreen screening to be planted with a height no less than 8 feet.D. Waivers. Upon application to the Architectural and Preliminary Site Review Board, the board may waive the 20-foot maximum width imposed in Subsection A of this section to provide additional room for driver visibility and safety, but in no event shall the curb cut exceed 22 feet.îSection 4. †Subsections E, Location, and H, Waivers, of ß 161-36, Retaining Walls, of said Code are hereby amended to read, respectively, as follows:ìE. Location.(1) † No retaining wall shall be located within four feet of a property line.(a) When a retaining wall is being used to increase an existing grade elevation it shall be located no less than 15 feet from a property line and shall be subject to the approval of the Planning Board in accordance with Chapter 100 of this Code.(b) When a retaining wall is being used to lower an existing grade elevation it shall be located no less than 6 feet from a property line and shall be subject to the approval of the Planning Board in accordance with Chapter 100 of this Code.(2) † No retaining wall shall be located within four feet of another retaining wall. The distance shall be measured in between walls.îìH. † Waivers. †Upon application to the Architectural and Preliminary Site Review Board or the Planning Board, either Board may waive the height and location restrictions imposed in Subsections D †and E of this section, and permit:(1) A retaining wall in excess of four feet in height, but not in excess of six feet in height, when the exposed face of the retaining wall that is in excess of four feet in height is facing away from the closest property line and the view of the retaining wall will not adversely impact the adjacent neighbors or the public from a public street; and, if such a waiver is granted pursuant to this subsection;(2) † A combined height of all retaining walls and fences within 20 feet of a property line in excess of eight feet, but not in excess of 10 feet, so long as the view of the retaining walls will not adversely impact the adjacent neighbors or the public from a public street.(3) A retaining wall located closer to a property line than imposed in Subsection E of this section, but no less than 4 feet from a property line.îSection 5. †Effective date. †This local law shall take effect immediately.Pursuant to the New York State legislation that permits public bodies to hold meetings remotely and without in-person access during the COVID -19 state disaster emergency, the meeting will be held without in-person access. †The public will have listening access to the meeting by attending at the Village Hall. †The meeting will be transcribed and the transcript made available to the public. †Any person who seeks the ability to listen to the meeting may do so at the Village Hall, 32 Steppingstone Lane, Kings Point, New York 11024. †Masks and social distancing will be required for all members of the public attending. †Persons who may suffer from a disability, which would prevent them from listening to the hearing, should notify Gomie Persaud, Village Clerk-Treasurer, at (516) 504-1000 in sufficient time to permit such arrangements to be made to enable such persons to listen to the hearing.Dated: Kings Point, New York
